Following Terms of Service (“Terms”) govern your access to and use of the Sparkly HR platform and services, whether through a free, paid or paid subscription. By registering for, accessing, or using the Sparkly HR platform, you agree to be bound by these Terms. If you do not agree, you should not use the platform.

1. Free and Paid Access

Sparkly HR offers both free and paid tiers for multiple user groups. The free tier provides access to core features such as personality-based assessments and analysis. Paid tiers unlock advanced features including detailed assessments and analytics, team compatibility insights, and human experts, employers, accelerators and investors tools.

2. Fair Use and AI Feature Limits

Sparkly HR uses AI-powered features to gain insights that are very complex and nearly impossible to reach otherwise. Sparkly HR remains the right to restrict the use of AI-powered features as determined solely by us. Programmatic or automated triggering of platform functionality beyond intended use is prohibited and may result in rate limiting, temporary suspension, or termination. AI features may rely on third-party services and are provided “as-is” without warranty of accuracy or completeness.

3. Data Privacy and Security (GDPR)

We are fully committed to protecting your data in compliance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and other applicable privacy laws.
Key principles:

  • You retain full ownership of your data.

  • All data is encrypted in transit and at rest.

  • We do not share your data with third parties without your explicit consent.

  • Your data is only accessed by authorized personnel for the purposes of providing and improving the service.

By using Sparkly HR, you grant us a limited license to process and store your data solely to provide the service, also for operational, support, and product development purposes. We may aggregate or anonymize data to improve platform features, in a manner that does not identify any individual or organization.

4. Acceptable Data Use

Sparkly HR is not designed to store or process:

  • Protected Health Information (PHI)

  • Financial or credit card data

  • Other regulated categories under GDPR Article 9 or similar frameworks

By using the platform, you agree not to upload or transmit such sensitive or regulated data unless covered by a specific signed Data Processing Agreement (DPA) with Sparkly HR. Sparkly HR is not liable for misuse of the platform beyond its intended scope.

5. Team Collaboration and Shared Workspaces

The platform supports collaborative usage. You may invite external 3-rd parties to access shared workspaces where recruitment data and team insights are visible. By inviting others, you confirm that:

  • You have the authority to do so.

  • You will not share access with unauthorized persons.

You are solely responsible for managing team access settings. Sparkly HR disclaims any liability for access granted to unauthorized users due to user mismanagement.

6. User Responsibilities

By using the platform, you agree to:

  • Comply with all applicable laws and these Terms.

  • Not reverse-engineer or misuse Sparkly HR infrastructure or AI.

  • Maintain accurate and up-to-date account information.

  • Keep your login credentials secure and not share access.

  • Use one account per user only.

7. Termination

We reserve the right to suspend or terminate access without prior notice in cases of:

  • Abuse of platform resources

  • Breach of Terms

  • Unauthorized use or access

8. Account Reactivation

You may reactivate a cancelled premium subscription at any time. A “catch-up” payment may be required to cover the subscription gap. Reinstatement after suspension for Terms violations is possible at our discretion and may also require a catch-up payment.

9. Feedback and Improvements

We welcome your suggestions and feedback. By submitting ideas, you grant Sparkly HR a non-exclusive, royalty-free right to use them for product improvement with no obligation to compensate you.

10. Changes to Terms

We may modify these Terms at any time. Updates will be posted on our website. Your continued use after such changes constitutes acceptance of the revised Terms.

11. Limitation of Liability

To the extent permitted under EU law, Sparkly HR is not liable for any indirect, incidental, or consequential damages resulting from your use of the platform. This limitation does not affect your statutory consumer rights under EU law.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. Any disputes will be resolved in Harju County Court (Harju Maakohus), unless otherwise required by applicable EU consumer protection laws.
